2) Eligibility & Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3) Products, Pricing & Availability

• We make reasonable efforts to display product colors, images, descriptions, and prices accurately; however, errors may occur. We may correct errors and update information without notice.

• Prices, promotions, and availability are subject to change at any time. Taxes and shipping fees are calculated at checkout as applicable.

• We reserve the right to limit quantities, refuse or cancel orders (including suspected fraud or mispricing), and to discontinue products.

4) Orders & Payment

• Orders are subject to acceptance. If we cancel an order after charging you, we will issue a prompt refund to the original payment method.

• U.S. orders typically arrive within seven (7) business days from order to delivery, subject to our Shipping Policy.

• Delivery times are estimates and may be affected by carrier delays, weather, or events beyond our control.

6) Returns & Refunds

• You may return eligible items within 20 days of delivery for a full refund to the original payment method, in accordance with our Return & Refund Policy.

7) Promo Codes, Gifts & Store Credit

• Promotional codes, discounts, gift cards, and store credits are subject to their stated terms, are non-transferable, and may not be redeemed for cash unless required by law. We may modify or cancel promotions at any time.

8) Intellectual Property

• All content on the Services—including text, graphics, logos, product images, videos, and software—is owned by or licensed to Nurturing Discoveries by Mimi and is protected by applicable intellectual property laws.

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, error-free, or secure operation.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Nurturing Discoveries by Mimi AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY; YOUR RIGHTS MAY VARY.

15) Indemnification

You agree to defend, indemnify, and hold harmless Nurturing Discoveries by Mimi from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your User Content, or your violation of these Terms or applicable laws.

16) Governing Law; Venue

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Allen County, Indiana, for any dispute not subject to arbitration or small-claims court.

17) Dispute Resolution (Informal & Optional Arbitration)

• Informal Resolution: Before filing a claim, contact us so we can try to resolve it informally within 30 days.

• Arbitration (Optional): By mutual written agreement, the parties may submit unresolved disputes to binding arbitration on an individual basis under the rules of a recognized arbitration provider. EACH PARTY WAIVES CLASS ACTIONS IN ANY FORUM TO THE FULLEST EXTENT PERMITTED BY LAW.

• You may always bring qualifying claims in small-claims court in your county of residence or in Allen County, Indiana.

18) Changes to the Terms

We may update these Terms from time to time. Changes apply when posted to the Services with the “Last updated” date above. Continued use after changes means you accept the updated Terms.

19) Severability & Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our posted policies, constitute the entire agreement between you and us regarding the Services and supersede prior understandings.
